Supreme Court Ends Trump’s ‘Remain in Mexico’ Policy

The has given President Biden the authority to end the hotly-debated “Remain in Mexico” policy.

President Trump implemented the Migrant Protection Protocols (MPP), more commonly known as “Remain in Mexico,” in 2019. The policy required asylum seekers to wait on the other side of the border while U.S. authorities process their applications.

Mexico accepted the policy's expansion to expedite deportations during the pandemic. However, President Biden ended it on his first day in office.

In August 2021, a U.S. District Court judge in Texas ruled the Biden improperly ended the program.

The Hill further reports:

Trump's “Remain in Mexico” policy, enacted in 2019, has remained in effect under President Biden despite his Department of Homeland Security's (DHS) effort to end it. Lower courts, in response to a red state legal challenge, have blocked DHS's two attempts to unwind the policy.

Under Trump, more than 70,000 asylum-seekers were returned from the U.S. to Mexico. His program, formally called the Migrant Protection Protocols (MPP), marked an extreme departure from the previous practice of allowing those fleeing violence and persecution to cross the border and remain in the U.S. while they apply for asylum, a process which can take years to complete.

Early into Biden's White House tenure, his administration sought to formally end the Trump-era policy. DHS Secretary Alejandro Mayorkas issued a memorandum in June 2021 ordering an end to the program, which prompted the legal challenge by the attorneys general of Texas and Missouri.

Texas-based U.S. District Judge Matthew Kacsmaryk, a Trump appointee, sided with the challengers and blocked Biden's effort to rescind the program. The judge concluded that federal law requires that the federal government either detain asylum-seekers at the southern border or return them to Mexico, effectively whittling away at presidential discretion.

  1. I suppose the Supreme court has no comment on the fact that Lying Corrupt Quid Pro KING Joe is breaking the law in the first place by Ignoring U.S. Immigration Law, and not enforcing the law. That’s an issue that should be before the court. The POTUS doesn’t have the right to break the law. See the game plan is to have as many illegals into the county ASSAP. Change the voting Demographics of the U.S. Give the illegals Amnesty and then citizenship. Give them lots of social programs and welfare. Why does one think they are coming to the U.S. Their own countries don’t take care of them. They expect the U.S. taxpayer to take care of them. America doesn’t take care of it’s own citizens, let alone take care of the exportation of another countries poverty. Once they are able to vote, they will be told in order to keep to generous welfare benefits they will have to vote Democrat, which in effect, America will have a one party rule for the foreseeable future. The Democrats are gaming the system. A one party rule= Communism. Communist China has a one party rule.

    • If I could I would give you a thumps up. You nailed it. It is the Great Replacement Theory. Bring in masses of illegals and grant them the ability to vote and they will cancel out our vote. This is real voter suppression. Allow the illegals by the masses and they will vote for the Democrats like asses.
      The only hope here is there enough current Hispanic and Latino Americans who know what is going on and derail this tactic by voting Republican. Maya Flores just won a special election for a House Seat as the first Mexican born American. You won’t here this on the mainstream media championing diversity and a new breakthrough as she ran and won as a Republican. She represents a border part of the country in Texas that has been overrun with illegals.

    • It’s time to do a nationwide petition to be put on ballots that we demand The wall be finished and every last illegal rounded up and shipped out. I don’t want any of my money paying for them especially when the government doesn’t take care of our Vets. Getting sick of all this BS!

  2. The ruling is just a fait accompli. The Biden crew had already invalidated the court order that reinstated the policy. The previous forms instructed applicants to stay in Mexico. DHS immediately changed the forms to: “Do you want to remain in Mexico?”

  3. The title of this article does NOT fit the content of the article. Sooo is the “remain in Mexico” policy still in effect or not? One would NEVER know from this article.

    • I was equally surprised when reading the contents. This does not make sense and gives two different outcomes. I tend to believe that Biden did not win on this issue because the SCOTUS previously determined that the decision was not theirs to make and Biden had to challenge the Texas ruling in the Texas Court. They also determined that Mayorkas did not have the authority to rescind Trump’s Order. It’s probably a moot point because neither Biden nor Mayorkas has paid any attention to Federal immigration laws since Biden’s inauguration anyway, but I believe (have not verified) that Texas has filed an impeachment against Biden for breaking immigration laws, and of course, it will probably take until 2024 for that to come to a hearing. In any event, several things are obvious: Both Biden and Mayorkas have knowingly ignored immigration laws and a SCOTUS Order, and enough evidence has accrued in the last 1-1/2 years to support Biden’s impeachment and conviction, hopefully for treason. We can only hope so, if we can replace enough Democrats in Congress at the midterms to hold this trainwreck at bay until a new conservative administration is elected and cleans house of all the self-serving politicians who are collaborating with the Dems to destroy America.

      • Addendum: The SCOTUS ruling was not that Biden didn’t have the authority to reverse Trump’s EO implementing the MPP, it was that Biden failed to follow the lawful procedure to do it. SCOTUS denied having any authority to give Biden that authority and ordered him to reclose borders and go duke it out in the Texas Sup. Ct. I do not recall seeing anything confirming that Biden actually did so and doubt he did since he has failed to follow a single law since he took office. The grounds for impeachment would be that he simply ignored the existing laws.

  4. Tough call and ruling here for the conservatives on the Supreme Court. If President Trump had the authority to enact Remain in Mexico then lying Biden has the same Constitutional authority to undue it. The court is not allowed to enact laws or favor laws but to see if what is done is Constitutional.
    In this case as much as a conservative I hate it, this action by lying Biden was in fact Constitutional. The price we pay for lost or should I stay stolen elections as lying Biden is in POTUS because of election fraud.

  5. I say round up every illegal and offer them the one time only option to become a naturalized citizen, but with these stipulations:

    Must learn English, our culture and our laws;
    Swear to uphold and defend the Constitution of the United States and to forsake their allegiance to their country of origin; and
    Stay out of politics for a minimum of one generation.
